What happens when your name is referred to the Department of Health Protection of Children Act List?
You will be held on a provisional list until the Secretary of State confirms your name on the Protection of Children Act list. Even on the provisional list it will be flagged up if a potential employer applies for Criminal Records Bureau clearance against your name.
This provisional listing will generally happen following a recommendation by the Fostering Panel, which following the completion of local investigations meets to hear the report. Provisional listing is important however in order to protect children and carers whilst the often protracted local investigations take place.
If your name remains on the provisional list for more than nine months, you may have the decision to confirm your name determined by the Protection of Children Act List Tribunal.
