What happens when your name is confirmed on the Protection of Children Act List?

If your name is confirmed on the Protection of Children Act List, you have three months to launch your appeal.

It is important that you instruct and involve your solicitor prior to this so that they can be briefed and ready to proceed if your name is confirmed.

This is a specialist area of the Law and it may be quite difficult to find suitable local help (see Associates) so I suggest that you start looking quite early on.

A copy of the regulations and proceedings of the Protection of Children Act Tribunal (established by section 9 of the Protection of Children Act 1999 and extended by the Care Standards Act 2002) can be obtained from the Home Office (see Associates).

This is a relatively new system, which promised to be a fairer system, and meet the requirements of the Human Rights Act. This system supersedes all other lists held by the Police, Department of Health and the Education Department. However, if your appeal fails and you decide against taking the case to Judicial Review you will have to wait ten years before being able to appeal again.
